Terms of use
Last updated: 30 October 2026
This is a courtesy translation. In case of discrepancy, the Spanish version prevails, unless the law applicable to a consumer provides otherwise.
These general terms govern access to and use of the BidTerra website and all its tools. They are general contractual terms under Spanish Law 7/1998 of 13 April and are permanently available on this page so that users can read, save and print them. Please read them carefully: they contain important warnings about the risks of buying at auction and limitations of the owner’s liability.
1. Acceptance and users
Accessing the site makes you a user and implies acceptance of these terms in the version published at any given time. If you do not accept them, you must not use the site.
The site is intended for persons aged 18 or over with full legal capacity. For the purposes of these terms, a consumer user is a person acting for purposes outside their trade, business, craft or profession, and a professional user is a person acting within such activity, including regular investors, companies, property professionals, lawyers, agents and institutions. Some clauses apply differently to each, as indicated.
2. Description of the service
BidTerra automatically collects notices of property auctions published by official sources, presents them on a map and in property sheets, generates summaries and warning signals from their text, shows aerial imagery of the area and offers calculation tools, market data, an auction history and explanatory guides. Use of the site is free of charge. The email alerts service is also governed by its specific terms.
The service is provided “as is” and “as available”, without warranties of any kind, express or implied, as to accuracy, completeness, timeliness, fitness for a particular purpose or uninterrupted operation, except those mandatorily imposed by law.
3. Source of the information and precedence of the official notice
- Sources. The data come from official portals and bodies and other public sources listed in Sources and credits. The owner does not produce or check them one by one and is not responsible for their content.
- Automated processing. Extraction, classification, summaries, term translations, geolocation and warning signals are generated automatically and may be wrong, incomplete or miss nuances of the notice.
- Time lag. The information is updated periodically, usually once a day. Between updates, notices may have been amended, suspended, cancelled, awarded or closed.
- Location and images. The position on the map may be approximate (for example, the centre of the municipality or postcode). Images are aerial orthophotos of the area from public services; they are not photographs of the property, may not correspond to the specific plot and may not reflect its current condition.
- Precedence. In case of discrepancy, the official notice, its edicts, its documents and the decisions of the body running the auction always prevail.
4. Warnings about buying at auction
Buying property at auction involves significant legal and financial risks, which the user assumes in full. Without limitation, users should bear in mind that:
- Encumbrances. Charges and encumbrances ranking before the enforcing creditor’s claim may survive and pass to the buyer. The list in the notice may be incomplete or out of date; a recent land registry certificate or extract should be obtained.
- Occupation and possession. The property may be occupied by the debtor, tenants or third parties. Obtaining possession may require long and costly proceedings and is not always possible.
- Physical condition. As a rule, the property cannot be visited. It is acquired in its existing condition, and in court sales there is no warranty against hidden defects (Article 1493 of the Spanish Civil Code). Floor area, use and features may differ between the Land Registry, the Cadastre and reality.
- Deposit and payment. A deposit is usually required to bid. If the successful bidder does not pay in time, the deposit may be lost and they may be liable for damages. The deposit and its return depend solely on the body running the auction.
- Costs and taxes. In addition to the price, transfer tax or VAT, stamp duty, notary, registry and cancellation costs, debts to the owners’ association and property tax for which the property is liable, professional fees and, in other countries, their own taxes and costs may apply. They vary by region, country and the buyer’s circumstances.
- Timetable and contingencies. Auctions may be suspended, postponed, annulled or declared void; the debtor may redeem the property; the creditor may take it; and pre-emption or redemption rights of authorities, tenants or co-owners may exist.
- Partial rights. What is auctioned may be an undivided share, bare ownership, a usufruct or another right short of full ownership.
- Planning. The property may lack permits, be non-conforming or be subject to use restrictions.
- Financing. Bank financing is often unavailable within auction payment deadlines.
- Other countries. Each country’s auctions are governed by its own law and procedure. BidTerra’s guides are explanatory, may not reflect recent reforms or the rules applicable to each procedure, and do not replace advice from a professional qualified in that country.
Users must personally verify all information, consult the case file and obtain advice from independent professionals (lawyer, court agent, tax adviser, valuer, architect or others) before taking part in any auction.
5. Tools, figures and market data
The calculator, deal analyser, market data, comparables and history are guidance tools. Their results depend on assumptions entered by the user and on public reference data (indices, averages, reference rents and past awards) that are not the price or rent of the specific property. They are not a valuation under Spanish Order ECO/805/2003 or any other rule, nor an investment recommendation or a reliable forecast. Past results do not guarantee future results.
6. No advice and no professional relationship
The contents of the site, including the guides, glossaries and warning signals, are general and explanatory. They do not constitute legal, tax, financial or any other advice, and their use creates no professional, agency or service relationship between the user and the owner, even if the owner or its collaborators have legal training or practise law. The owner does not examine any user’s particular situation.
7. User obligations and prohibited uses
Users undertake to use the site lawfully, in good faith, in accordance with public order and with these terms. In particular, it is prohibited to:
- systematically or massively extract or reuse the content of the site by any automated means (robots, scrapers, crawlers or similar) or manually, or to access its interfaces or data files other than through normal browsing;
- reproduce, distribute, sell, sublicense or make available to third parties the content or database of the site, or use them to create a product or service competing with BidTerra;
- frame the site within other pages or present its content as one’s own or as official;
- overload or interfere with the site, circumvent technical or security measures, introduce malware or attempt to access non-public areas;
- use any personal data contained in official notices for any purpose other than learning about the auction, and in particular to contact, profile, harass or harm debtors, occupants or other persons;
- provide false data or third-party data without authorisation, for example when subscribing to alerts.
The owner may block access by anyone in breach of these terms, without prejudice to any legal action.
8. Intellectual and industrial property
The software, design, structure, selection and arrangement of contents, original texts, guides, summaries, translations, graphics and distinctive signs of the site, including the name “BidTerra”, belong to the owner or its licensors and are protected by the Spanish Intellectual Property Act (Royal Legislative Decree 1/1996) and industrial property law. The owner is also the maker of the site’s database and holds the sui generis right under Article 133 of that Act.
Personal consultation and quotation of short extracts with attribution and a link to the site are permitted. Any other reproduction, distribution, public communication or transformation requires the owner’s prior written authorisation. Nothing in this clause limits the rights granted to lawful users over insubstantial parts by Article 134 of that Act.
Information from official and third-party sources keeps its own regime and is reused under the conditions and licences listed in Sources and credits.
9. Links
The site links to official portals and third-party pages that the owner does not control. The owner is not responsible for their content, availability, accuracy or policies, in accordance with Article 17 of the LSSI. Linking to BidTerra’s home page is permitted provided the link does not suggest a non-existent relationship, sponsorship or official status and the site is not reproduced within another page.
10. Availability and changes to the service
The owner does not guarantee the continuous availability of the site or of its sources. For technical, security, legal or organisational reasons, the owner may modify, temporarily suspend or discontinue any free feature without any right to compensation. Changes affecting paid services are governed by their specific terms.
11. Liability
To the fullest extent permitted by law, and bearing in mind that the site is free and informative, the owner shall not be liable for loss or damage of any kind arising from:
- errors, omissions, delays or inaccuracies in the information on the site or from official and third-party sources;
- decisions the user makes, or fails to make, on the basis of the information or tools on the site, including paying deposits, bidding, buying, financing or exploiting properties;
- loss of opportunities, deposits, profits or anticipated savings, and indirect or consequential loss;
- unavailability, interruption or malfunction of the site, official portals or third-party services, or non-receipt of alerts;
- viruses or other harmful elements, provided the owner has taken reasonable measures to prevent them;
- use of the site contrary to these terms or to the law.
As regards professional users, the owner’s total aggregate liability on any ground is limited to the greater of: the amount actually paid by the user to the owner in the twelve months preceding the event giving rise to the claim, or one hundred euros.
Nothing in these terms excludes or limits the owner’s liability for wilful misconduct or gross negligence, for personal injury, or the rights that consumer law makes non-waivable (in particular Spanish Royal Legislative Decree 1/2007 and the mandatory rules of the consumer’s country of residence). The above limitations apply to consumer users only to the extent that such law allows.
12. Indemnity
Users shall hold the owner harmless from third-party claims, penalties and reasonable costs, including lawyers’ and court agents’ fees, arising from the user’s culpable breach of these terms or of the law.
13. Data protection
The processing of personal data is described in the privacy information and the cookie policy.
14. Changes to the terms
The owner may amend these terms due to changes in legislation or case law, the addition, modification or removal of features, security reasons or changes in information sources. The version in force is the one published on this page, with its update date, and applies from publication to subsequent use. Changes affecting paid services will be notified with the notice period set out in their specific terms.
15. Other provisions
- Severability. If any clause is held void or unenforceable, it shall be deemed not included and the remaining terms shall remain in force.
- No waiver. The owner’s failure to exercise a right at any time does not constitute a waiver of it.
- Assignment. The owner may assign its position to a company that continues operating the site, provided this does not reduce the safeguards of consumer users.
- Force majeure. The owner shall not be liable for failures due to causes beyond its reasonable control.
- Language. These terms are drafted in Spanish; versions in other languages are courtesy translations and, in case of discrepancy, the Spanish version prevails, unless the law applicable to a consumer user provides otherwise.
16. Complaints, governing law and jurisdiction
Before going to court, the user and the owner will try in good faith to settle any dispute through direct negotiation, in accordance with Spanish Organic Law 1/2025 of 2 January. Users may submit complaints by writing to [email protected]; the owner will reply as soon as possible and in any event within thirty days. The owner does not currently adhere to any consumer arbitration scheme or alternative dispute resolution body.
These terms are governed by Spanish law. If the user is a consumer, this does not deprive them of the protection afforded by the mandatory rules of their country of habitual residence, and they may bring proceedings in the courts of their domicile. If the user is a professional, the parties expressly submit, waiving any other jurisdiction, to the courts of the owner’s domicile.
