This information is provided in accordance with Articles 13 and 14 of Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on Personal Data Protection and Guarantee of Digital Rights (LOPDGDD).

2. Using the site without personal data

You do not need to register or provide any data to use BidTerra. The preferences you choose (favourites, property comparison, country, guide regime and light or dark theme) are stored only in your own browser and are not sent to the owner. See the cookie policy.

3. Processing we carry out

a) Browsing and security
Data: IP address, date and time, page requested, browser and similar technical data, processed by the hosting provider when serving the site. Purpose: providing the service, preventing abuse and ensuring security. Legal basis: the owner’s legitimate interest (Art. 6(1)(f) GDPR). The owner does not use these data to identify visitors.
b) Email alerts service
Data: email address, search criteria (country, provinces, property types, maximum value), language, sign-up date, subscription status and a management code. Purpose: sending the alerts you request, confirming your email and handling cancellation. Legal basis: performance of the service you request (Art. 6(1)(b) GDPR). Before signing up you must confirm that you have read this information.
c) Subscription payment (once enabled)
Data: email, customer and subscription identifiers, amount, dates and payment status. Card data are received and processed directly by Stripe; the owner has no access to them. Purpose: charging for the service and complying with accounting and tax obligations. Legal basis: performance of the contract and compliance with legal obligations (Art. 6(1)(b) and (c) GDPR).
d) Communications with the owner
Data you provide when writing to us. Purpose: dealing with your query, complaint or exercise of rights. Legal basis: your request and, where applicable, compliance with legal obligations (Art. 6(1)(b) and (c) GDPR).
e) Personal data contained in official notices
Notices published by the bodies running auctions may contain data on natural persons, such as the names of debtors, owners or occupants and case references. BidTerra obtains them from those official publications and shows them only as part of the notice for the property, in order to inform about public auctions. Legal basis: legitimate interest in making known proceedings that the law requires to be published (Art. 6(1)(f) GDPR). BidTerra does not allow searching by a person’s name, does not build profiles and removes closed notices from general browsing. Given the number of persons concerned, informing them individually would involve disproportionate effort (Art. 14(5)(b) GDPR); this information is made publicly available. You may object to the processing at any time.

No automated decisions with legal effects are taken about you, no profiles are built for commercial purposes, data are not shared or sold, and no marketing communications are sent: only the service emails you request.

4. Recipients and processors

In addition, to display maps and aerial imagery, your browser requests tiles directly from OpenFreeMap and the Spanish National Geographic Institute, and map libraries from cdnjs (Cloudflare) and jsDelivr; orthophotos of Italy are fetched through BidTerra’s own server. These providers receive your IP address, as with any web request, and apply their own policies.

Data will not be disclosed to third parties except where required by law or by a competent authority.

5. International transfers

Some providers are established in, or process data in, the United States. Transfers rely on the adequacy decision for the EU-US Data Privacy Framework for certified entities and, otherwise, on the standard contractual clauses approved by the European Commission (Art. 46 GDPR).

6. Retention

7. Your rights

You may exercise your rights of access, rectification, erasure, objection, restriction of processing and portability, and withdraw any consent given at any time, by writing to [email protected]. You can cancel alerts at any time through the link in each email. If you believe the processing does not comply with the law, you may lodge a complaint with the Spanish Data Protection Agency (www.aepd.es) or with the supervisory authority of your country of residence.

8. Minors

The site is not intended for persons under 18, who must not provide personal data or subscribe to the alerts service.

9. Security

The site is always served over an encrypted connection (HTTPS) and technical and organisational measures appropriate to the risk are applied. Confirmation and cancellation links contain a personal code: do not share them.

10. Changes

This information may be updated to reflect legal or service changes. The version in force is the one published on this page.
